A federal judge in Virginia ruled in favor of the Trump administration Friday, declining to join other federal courts that halted the President's revised travel ban last week.
The Maryland ruling stopped the revised executive order's 90-day ban on travel into the U.S.by citizens of Iran, Libya, Somalia, Sudan, Syria and Yemen.
The legal issue before him, Trenga wrote, "is whether EO-2 falls within the bounds of the President's statutory authority or whether the President has exercised that authority in violation of constitutional restraints".
"It is no longer likely that Plaintiffs can succeed on their claim that the predominate objective of [executive order 2] is to discriminate against Muslims based on their religion and that [the order] is a pretext or a sham for that goal", the judge wrote. The White House has appealed the injunction in Maryland.
At a hearing earlier this week, Judge Anthony Trenga questioned whether an injunction was necessary, given the fact that judges in Hawaii and Maryland have already blocked the vast majority of the executive order from taking effect.
At this stage of the lawsuit, Trenga concluded, the plaintiffs have not demonstrated a likelihood to succeed on the merits.
While the Federal Bureau of Investigation did not provide details on what states the threats are originating, sources toldCBS affiliate KGMB that they are coming from the mainland, or the continental U.S.
