Trump travel ban upheld but previous block rulings remain

Activists Gather In Times Square In Day Of Solidarity With American Muslims

A federal judge in Virginia ruled in favor of the Trump administration Friday, declining to join other federal courts that halted the President's revised travel ban last week.

The Maryland ruling stopped the revised executive order's 90-day ban on travel into the U.S.by citizens of Iran, Libya, Somalia, Sudan, Syria and Yemen.

The legal issue before him, Trenga wrote, "is whether EO-2 falls within the bounds of the President's statutory authority or whether the President has exercised that authority in violation of constitutional restraints".

"It is no longer likely that Plaintiffs can succeed on their claim that the predominate objective of [executive order 2] is to discriminate against Muslims based on their religion and that [the order] is a pretext or a sham for that goal", the judge wrote. The White House has appealed the injunction in Maryland.

At a hearing earlier this week, Judge Anthony Trenga questioned whether an injunction was necessary, given the fact that judges in Hawaii and Maryland have already blocked the vast majority of the executive order from taking effect.

At this stage of the lawsuit, Trenga concluded, the plaintiffs have not demonstrated a likelihood to succeed on the merits.

While the Federal Bureau of Investigation did not provide details on what states the threats are originating, sources told CBS affiliate KGMB that they are coming from the mainland, or the continental U.S.

Judge Trenga on Friday (24 March) rejected claims of discrimination by the Council on American-Islamic Relations (CAIR).

Finally, 10.5% of readers said they were neutral on the travel ban and were willing to see how it turned out once put into effect. "The notion that one can demonstrate animus toward any group of people only by targeting all of them at once is fundamentally flawed", Watson wrote.

Watson also went so far as to tell the federal lawyers who protested his ruling that "there is nothing unclear" about his remarks on Sunday.

Hawaii Attorney General Douglas Chin said in court papers Saturday that the easy implementation of the laptop policy belies any claim that Trump's "hands are tied" by litigation seeking to overturn the travel ban on the grounds that it discriminates against Islam.

Trenga said that even though Trump used the phrase "Muslim ban" as rhetoric on the campaign trail, it shouldn't be held against the president with regard to the executive order, as the judge in Hawaii previously suggested. But James says the laptop ban on flights might be the one time he's right.

"The fact that the White House took the highly irregular step of first introducing the travel ban without receiving the input and judgment of the relevant national security agencies strongly suggests that the religious objective was primary and the national security goal, even if legitimate, is a secondary, post hoc rationale", Chuang wrote.
