What to know about travel ban appeals

A federal appeals court panel of three Democratic appointees grappled with questions Monday over how to determine whether President Donald Trump's revised travel ban was motivated by religious prejudice or national security.

The lawyer for Hawaii also suggested that this panel of judges did not have to deal with the hard issue of its authority to look beyond the actual text of the Trump order to consider the many statements by Trump that he was going to impose a "Muslim ban".

Last week, judges on the 4th Circuit Court of Appeals heard arguments over whether to affirm a Maryland judge's decision putting the ban on ice.

"The measures that he took in that executive order are fully lawful, fully compliant, and make it clear that they seek to keep this country safe, that's it, " Spicer says.

The judges in Seattle are hearing arguments over Hawaii's lawsuit challenging the travel ban, which would suspend the nation's refugee program and temporarily bar new visas for citizens of Iran, Libya, Somalia, Sudan, Syria and Yemen.

"Has the president. ever said, 'I said before I want to ban all members of the Islamic faith from entering the United States of America, I was wrong, I have consulted with lawyers, I am now addressing it simply to security?'" asked Senior Circuit Judge Michael Daly Hawkins.

Attorney Neal Katyal, arguing on behalf of the plaintiffs, suggested "this is a repeated pattern of the president". But the judge wondered whether Trump is forever forbidden from adopting an executive order along the lines of his travel ban. But which of the complex set of issues the court might consider - from the First Amendment religious bias issue, to claims Trump's order violates Due Process or Equal Protection rights and statutory rules, remains unclear. Well, Mr Wall said, he did say some things "approaching that"-which was a fancy way of saying no, he hasn't".

He did not address why Trump hasn't disavowed his calls during the campaign for a ban on Muslims entering the country.

Katyal doubled down on this line of argument Monday, contending, as the district court had, that no reasonable objective observer could not see that the goal of the order was to disfavor Muslims.

"No one has ever tried to set aside a law that's neutral on its face and neutral in its operation on the basis of campaign statements made by a private citizen running for office", he contended. In that event, the White House might have to rethink the outlines of an order to carry out one of Donald Trump's signature promises as a candidate and as president.

Judge Richard Paez appeared skeptical, asking how Wall's legal analysis squares with Korematsu v.

Acting U.S. Solicitor General Jeffrey B. Wall said Trump has made many statements about pursuing efforts to combat terrorists.

The federal judges aggressively questioned both sides about the president's authority to restrict visas from six majority-Muslim countries, and if any comments Trump made against Muslims matter.

Paez also touched upon the broad nature of Trump's travel ban.

When a federal judge in Hawaii blocked core portions of the revised ban back in March, Trump cried that it was an "unprecedented judicial overreach".

Dozens of advocates for refugees and immigrants rallied outside the federal courthouse in Seattle, some carrying "No Ban, No Wall" signs.

Trump's attempted travel bans have caused the number of refugees coming into the U.S.to plummet in the last two months, despite his executive orders largely being blocked in the courts.

And the U.S. Court of Appeals for the 9th Circuit, which already prevented an earlier version of the executive order from being enforced, seemed to once again harbor doubts about it, despite Trump's attempt in March to water it down and insulate it from legal challenges. The U.S. Supreme Court is likely to be the ultimate decider, but the high court is not expected to take up the issue for several months.

"What's happening today-it's not internment camps; it isn't, but it's a chilling reminder of what could happen if we allow executive orders like this to go forward", said Chin.

Paez also questioned Katyal about Trump's statements, calling them "profound".
